I went to Walmart to have my tires rotated and my oil changed and got my car back damaged!?

I went to Walmart to have my oil changed and my tires rotated a year ago and they damaged my bumper,my radiator and my prop rod was missing. I am still waiting for any resolution from their bs insurance company CMI. I reported them to the BBB with no response from Walmart. Dear Janet, It is ridiculous to me that a big corporation like Walmart has wasted so much of my time after damaging my car. I am a very small fish in the world and maybe that is why nothing has happened with my claim. I called you back about my claim and as usual I have received no response from you or Walmart. It has almost been a year since the incident happened. If I do not hear back from you I will be taking Walmart to small claims court very shortly to recover my loses. Walmart damaged my car I had to pay to repair it before any more damage was caused by their negligence, and waste more of my time with the better business bureau which was thrown out with no response back from Walmart my case was closed. I will take Walmart to small claims court I have a witness that can testify in my behalf that there was nothing wrong with my car when he dropped it off. I have the papers from Walmart that states my radiator was not leaking when Walmart received it. A manager told me that they would not have repaired my car if the radiator was leaking. After we go to court I will proceed with having the state also investigate Walmart and the practices they use to cover their tracks after damaging a customers car. Sincerely, Brett Krusniak

Dear Janet, Are you serious? After a year has gone by and you have done nothing with my claim you want me to explain to you how my radiator was damaged by raising and lowering the hood? Why don't you explain to me how you bring a car in for an oil change and tire repair and rotation and get your car back with no prop rod, a radiator pouring out coolant and the bumper cracked. Not to mention that the tire that had a slow leak has had a slow leak ever since I paid for it to be repaired. How does all of this happen by raising and lowering the hood? I think News 8 live on your side would definitely like to find the same things out! I have kept every correspondence from CMI and Walmart. You can't tell me that the video at Walmart doesn't show exactly what happened to my car. I will get you the estimates but I spent well over an hour of my time at Walmart so they could take pictures of the damage to my bumper and the missing prop rod. Are you telling me you do not have those? You also should have the bill for my radiator. Do you want a copy of the Better Business Bureau report also to explain the events to you? Your insurance company I believe is a stall tactic to try to get the customer to give up on ever getting compensation for their loses from Walmart but I am not some one who will just give up. I have done nothing more than come to Walmart for a service and when I was laid off from my job I had to come up with the money to fix my radiator which had nothing to do with me and I expeditiously reported to Walmart what had happened during the service to my car on the same day. If you are going to try and drag this out and frustrate me even further please tell me now because my fuse is short at this point in time and I am not feeling amicable. I really do not see why I have to keep playing games with you and I really do not want anyone else to have to deal with this frustration either so why don't you just tell me now what you plan on doing or I will proceed in a more positive direcI went to Walmart to have my tires rotated and my oil changed and got my car back damaged!?So how does anybody lose a prop rod, unless it either wasn't there, or the hinged end was broker? You have said they damaged your radiator, but you, unfortunately have not said where the leak was, and what the rad repair shop said was the problem.

Bumper damage could have been done by another motorist in the parking lot, and you have given us no description that would indicate Wal-Mart did the damage.



I can't speak for anybody else, but I see nothing to indicate Wal-Mart has done anything wrong. You would have to give a description of the damage, where it was, what it looked like, and what the repair people noted.

Perhaps the claim is stil outstanding because there is no evidence Wal-Mart is responsible? If you take it to court, even small claims, it will be up to you to prove they damaged it, that it was undamaged before they took it in the shop, and was damaged while actually in the shop, or being driven by a Wal-Mart employee.

You have my sympathy for your frustrations.

Stop the emails and dances to walmart. Hire a lawyer or get a free legal consult of what to do next. It's been one year, walmart is messing with you.



About 8 months ago I got my windows tinted at my local nissan dealership. That night I noticed the passenger side door had a big dent in it. I went back to nissan and demanded them to fix my s*it. They did and detailed it, gave me a new set of tires, and free oil changes up to one year.

I'm curious as well how the radiator damage is connected. It sounds more like a poorly timed coincidence unless the bumper was damaged to the point of it also piercing the radiator. Hate to say it, but that one part sounds like poorly timed radiator leak. As far as customer service is concerned, it would be a wise choice for them to pay for the radiator if they did the other damage.



What kind of damage was it? I'm asking because I'm curious how it was damaged. Is it possible that it is from a car hitting your car? That is something you want to consider before you end up taking it to court.



As far as dealing with insurance companies and lawsuits, you're doing yourself a huge disservice by the ranting and raving in the letter. I know it helps feel better, but:



1) You're just going to delay the process longer. The more opinions you put into something like that, the less time the person will have to read what you are saying. They'll likely set it aside for another time. Keep your message very clear. You might even want to set down a bullet listing of points rather than an actual letter.



2) It might hurt if it does get taken to court. It will show an irrationality on your part. Her letter, while seemingly unhelpful in your situation, was at least very direct and professional. It said she tried to contact you on such and such a date and got a certain message. To proceed, she needs certain information and evidence.



3) %26quot;Why don't you just tell me now what you plan on doing...%26quot; She did. She said to send her this information and then they will proceed from there. It sounds like you did not send her pictures (you assumed Wal Mart would send those pictures on). It is not their job to provide the evidence if you're the one making the damage claim. If anything, they would try to not have evidence.



I'm not saying they're not at fault. It sounds like they are. You would get better response if you cut your letter back to three paragraphs of 3 maybe 4 sentences each. Just say what you want and why.
